This website is operated by Two Curly Girls Limited, trading as nails.co.nz. Throughout this website, the terms "we", "us", and "our" refer to Two Curly Girls Limited trading as nails.co.nz.
nails.co.nz is a New Zealand supplier of professional nail products, education, training, and related services.
By accessing our website, purchasing products, booking education or training, paying a deposit, or using any of our services, you agree to be bound by these Terms of Service together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referenced on this website.
If you do not agree with these Terms, you must not use this website or our services.
Our online store is hosted by Shopify Inc., which provides the e-commerce platform that enables us to offer products and services online.
SECTION 1 – WEBSITE USE
By using this website you confirm that you:

SECTION 2 – PROFESSIONAL USE PRODUCTS
Our products are intended and marketed primarily for professional use by qualified nail technicians and trained users.
Professional nail products contain chemicals that require safe handling and correct application techniques.
It is the customer's responsibility to:

follow all instructions, warnings and Safety Data Sheets (where applicable);

use appropriate personal protective equipment where required; and

comply with all applicable health and safety requirements.
Nothing in this section limits any rights that cannot legally be excluded under New Zealand law.
SECTION 3 – GENERAL CONDITIONS
We reserve the right to:

refuse service;

decline course enrolments;

cancel orders;

limit quantities purchased; or
-
refuse future transactions,
where permitted by law.
Content transmitted across the internet (excluding payment information) may pass across various networks.
All payment information is encrypted and processed securely by our payment providers.
You must not reproduce, distribute, copy or exploit any part of this website, our education materials or intellectual property without our prior written permission.
SECTION 4 – ACCURACY OF INFORMATION & THIRD-PARTY LISTINGS
We make reasonable efforts to ensure that product information, images, sizes, variants, pricing and availability displayed on nails.co.nz are accurate and up to date.
Our products may also appear on third-party platforms and services, including Google, Google Shopping, search engines, social media platforms and other advertising or shopping services. These third parties may automatically select, combine or display product images, prices, descriptions, sizes or variants in a way that differs from the information displayed on our website. We do not control how third-party platforms present this information.
Where a product is available in multiple sizes, colours or variants, a third-party platform may display an image of one variant alongside the price of another variant, including the lowest-priced option.
Before completing a purchase, customers are responsible for checking the product, size, colour, variant, quantity and price selected on nails.co.nz, including the information shown in their cart and at checkout.
The product, variant and price selected and confirmed on nails.co.nz at the time the order is placed form the basis of the customer's order, rather than information displayed by a third-party platform.
If there is a discrepancy between information displayed by a third-party platform and the information displayed on nails.co.nz, customers should refer to the information on nails.co.nz or contact us for clarification before placing their order.
Product information, specifications, pricing and availability may change without notice.
Nothing in this section limits or excludes any rights or remedies available under the Fair Trading Act 1986, Consumer Guarantees Act 1993, or any other rights that cannot lawfully be excluded under New Zealand law.
SECTION 5 – PRODUCTS & ORDERS
We reserve the right to:

refuse any order;

limit purchase quantities;

cancel suspected fraudulent orders;

refuse orders intended for unauthorised resale.
Product photographs are provided for illustration only.
Actual colours may vary depending on individual monitor or device settings.
SECTION 6 – PRICING
Prices are shown in New Zealand Dollars (NZD) unless otherwise stated.
Prices, promotions and product availability may change without notice.
Errors in pricing or product information may be corrected at any time.
Where an obvious pricing error has occurred, we reserve the right to cancel the order and provide a full refund.
SECTION 7 – PAYMENT
Payment must be received before orders are dispatched unless otherwise agreed.
Ownership of goods remains with Two Curly Girls Limited until payment has been received in full.
SECTION 8 – RURAL DELIVERY
Some delivery addresses are classified as Rural Delivery (RD) by our courier providers.
Any applicable Rural Delivery surcharge is determined by the courier company and is not set by nails.co.nz.
Customers who cancel an order because a Rural Delivery surcharge applies will be subject to our standard Change of Mind cancellation policy.
SECTION 9 – SHIPPING & DANGEROUS GOODS
Certain products are classified as Dangerous Goods under New Zealand transport legislation.
Dangerous Goods products may require specialised freight services and may incur additional delivery restrictions or charges.
Where applicable, customers agree to comply with all Dangerous Goods transport requirements relating to returns.
SECTION 10 – BACKORDERS
Products marked as Backorder are purchased with the understanding that dispatch dates are estimates only.
Supplier delays, manufacturing delays and freight disruptions may affect estimated arrival dates.
Cancelling a Backorder before dispatch will be treated as a Change of Mind cancellation.
SECTION 11 – ORDER COLLECTION
Orders selected for Click & Collect should be collected within 60 days of notification.
After 60 days, products may be returned to available stock.
Ownership of the order remains with the customer.
Where products have subsequently sold out, replacement stock will be supplied once available.
SECTION 12 – RETURNS & REFUNDS
Returns, exchanges and refunds are governed by our Refund Policy together with applicable New Zealand legislation.
SECTION 13 – CONSUMER GUARANTEES ACT
Where products are purchased for personal, domestic or household use, customers may have rights under the Consumer Guarantees Act 1993.
Where products or services are acquired for business purposes, the parties agree to contract out of the Consumer Guarantees Act to the fullest extent permitted by law.
SECTION 14 – EDUCATION SERVICES
All education bookings require a non-refundable deposit.
Course places are secured only once the required deposit has been received.
Students agree to the separate Education & Training Agreement upon enrolment.
Where payment plans are offered, accounts must remain current.
Certification will not be issued until all course fees have been paid in full.
Students have 12 months from course completion to submit portfolio work unless otherwise agreed.
SECTION 15 – INTELLECTUAL PROPERTY
All website content, branding, product photography, educational material, graphics and logos remain the property of Two Curly Girls Limited unless otherwise stated.
No material may be reproduced without written permission.
SECTION 16 – PRIVACY
Personal information is collected and managed in accordance with the Privacy Act 2020 and our Privacy Policy.
SECTION 17 – LIMITATION OF LIABILITY
To the fullest extent permitted by New Zealand law, Two Curly Girls Limited shall not be liable for indirect, incidental or consequential losses arising from the use of this website, products or services.
Nothing in these Terms excludes rights that cannot legally be excluded.
SECTION 18 – GOVERNING LAW
These Terms are governed by the laws of New Zealand.
SECTION 19 – CHANGES TO THESE TERMS
We may amend these Terms at any time by publishing updated Terms on this website.
Continued use of the website constitutes acceptance of those changes.
